Am I responsible for statements made by my agent when selling my horse?

Many horse owners chose to use a sales agent to sell their horse. They may not realise that they are likely to be responsible for statements made by the agent to a buyer of the horse, even if they didn’t tell the agent to make those statements.

If an agent makes an untrue statement about a horse, the buyer of the horse may have a right to bring a claim against the seller of the horse (in the law of misrepresentation) just as if they had made the statement themselves.

It is therefore important to ensure that any agent retained to sell a horse has clear instructions about how to market the horse.
